Stephanie Jenkins speaks with My Carolina Today about Child Support in North Carolina

Where does the child support fit into the child custody when separation and divorce occur? One parent may have a court mandated amount that they have to pay each month. There are some issues where the parent paying child support is not making the payments. North Carolina has a pretty good enforcement system. In Wake County, there is a child support enforcement agency. The courts in North Carolina are sensitive to the needs of children. Child support will vary by state.

Two key points to know in North Carolina are 1) Guidelines or 2) Not Guidelines. If the combined income is $300,000 or less, the couple is with the guidelines. If it’s more than $300,000 combined, the couple is off the guidelines. Child Support: Combined pretax annual incomes of both parents.
If someone is within the guideline, there is a set amount based on the guidelines. Most judges will likely go with the guidelines unless there are good reasons not to. If the couple is off the guideline, there will be different factors involved in determining the Child Support amount.

Child Support is NOT tax deductible. Child Support is not taxable as income for the person receiving it.

Child Support: Continues until the child reaches 18, or emancipated. Child support is not court ordered beyond age 18 even if the child is in college.

Not paying Child Support can be civil or even criminal in nature. Someone can be put in jail until the child support is paid. If the supporting parent moves out of state, the parent receiving child support will then likely have to work with the state the other parent moved to. Child Support can get complicated and be very emotional.

Child Support and visitation rights are separate from each other and one is not contingent on the other.
